Florida's Medcial Marijuana Laws

In November 2016, Florida passed Amendment 2, allowing medical marijuana to be cultivated and dispensed to qualified patients. This amendment ensures safe access to medical cannabis for those with debilitating conditions, making Florida the first southern state to take proactive steps toward cannabis legalization.

Under this law, individuals with certain medical conditions, as determined by a licensed physician, can use marijuana for medicinal purposes. Caregivers can also register with the Department of Health to assist patients. Medical Marijuana Treatment Centers are now open to serve qualified patients and caregivers.

To qualify for medical marijuana in Florida, patients must have a debilitating condition such as cancer, epilepsy, glaucoma, HIV/AIDS, PTSD, ALS, Crohn’s disease, Parkinson’s disease, multiple sclerosis, or other similar conditions. Patients must obtain a physician certification, which confirms the condition and the doctor’s belief that the benefits of marijuana outweigh the risks. Minors can also receive certification with parental or guardian consent.

This November, we get the opportunity to vote for adult use (21 and up) recreational legalization with Amendment 3 on the ballot. This does NOT include home grow, however it does not mean that home grow won’t come later. Due to Florida’s single subject rule for Constitutional Amendments, both legalization and home grow could not both be written into Amendment 3. Home grow will have the opportunity to come later through additional legislative sessions and votes. Legalization for adult use is our first step, therefore, Krewe de Kannabis encourages you to vote YES to Amendment 3 on November 5, 2024.

Amendment 3: Adult Personal Use of Marijuana:

Allows adults 21 years or older to possess, purchase, or use marijuana products and marijuana accessories for non-medical personal consumption by smoking, ingestion, or otherwise; allows Medical Marijuana Treatment Centers, and other state licensed entities, to acquire, cultivate, process, manufacture, sell, and distribute such products and accessories. Applies to Florida law; does not change, or immunize violations of, federal law. Establishes possession limits for personal use. Allows consistent legislation. Defines terms. Provides effective date.
